1. Agreement to Terms

By accessing or using AI Passport Photo at aipassportphoto.co (the "Service"), operated by Picanha L.L.C-FZ, a company registered in the United Arab Emirates (Registration No. 2203851.01), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

AI Passport Photo is an online service that uses artificial intelligence to transform user-uploaded photographs into government-compliant passport and ID photos. The Service generates photos formatted to meet the official specifications of various countries, including correct dimensions, background color, head positioning, and resolution requirements.

3. Eligibility

You must be at least 18 years of age to use the Service independently. Parents or legal guardians may use the Service to create passport photos for minors under their care. By using the Service, you represent that you have the legal authority to agree to these terms.

4. Use of the Service

When using the Service, you agree to:

• Upload only photographs that you have the right to use (i.e., photos of yourself or of a minor for whom you are the legal guardian).
• Not upload photographs of other individuals without their explicit consent.
• Provide accurate information, including a valid email address for delivery of download links.
• Not use the Service for any unlawful purpose, including but not limited to identity fraud or document forgery.
• Not attempt to reverse-engineer, disrupt, or exploit any part of the Service.

5. Pricing and Payment

• The Service offers paid packages: a digital download and a digital download with a print-ready PDF.
• Prices are displayed at checkout and are subject to change without prior notice.
• All payments are processed securely through Stripe. We do not store your credit card details.
• Prices are listed in US Dollars (USD) unless otherwise indicated.

6. Delivery

Upon successful payment, you will receive an email containing secure download links for your passport photo. Download links are valid for 7 days from the date of purchase. It is your responsibility to download your photos within this period. If you experience issues with delivery, contact us at support@aipassportphoto.co.

7. Refund Policy

We offer a 30-day refund policy. If you are unsatisfied with the quality of the generated passport photo, or if your photo is rejected by a government authority, you may request a full refund within 30 days of purchase. To request a refund, email us at support@aipassportphoto.co with your order details and reason for the request. Refunds are processed to the original payment method within 5-10 business days.

8. Compliance Disclaimer

While our AI is designed to produce photos that meet official passport photo specifications for various countries, we cannot guarantee acceptance by every government authority or processing office. Requirements may change, and individual offices may interpret guidelines differently. We recommend checking the latest requirements from your country's passport authority. Our refund policy applies if your photo is rejected.

9. Intellectual Property

You retain all rights to the photographs you upload. By uploading a photo, you grant us a limited, temporary license to process the image solely for the purpose of generating your passport photo. We do not claim ownership of your photos. The Service itself, including its design, code, AI models, and branding, is the property of Picanha L.L.C-FZ and is protected by applicable intellectual property laws.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Picanha L.L.C-FZ shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of the Service. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid for the specific service giving rise to the claim. This limitation applies regardless of the theory of liability.

11. Indemnification

You agree to indemnify and hold harmless Picanha L.L.C-FZ, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any rights of a third party.

12. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated revision date. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts in the UAE.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
